Note Deposition of Stephen Rogers, an acquaintance of Silas Martin, made in Nov 1894:

I am 35 years old. I am a farmer & teamster. My P.O. address is Fairfield, Ill.

I knew Silas L. Martin who formerly lived here. I do not know when he lived here but it has been 8 or 10 years ago, he lived here about one year. He built a house for me. Martin was a married man when he came here. He brought a wife and two or three children here with him, I think he had been married twice. The reason I think this is that he was living with his wife and his first wife came here and lived here in town. I was told it was his wife, he tried to keep it hid. He run her I know that. I saw him out buggy riding with this woman, and he went to her house three or four times a week both night and day. I do not remember of ever speaking to him about her. I do not remember now whether there was any talk, but there was room for talk. The woman had no company that I knew of except Martin. I lived in the same yard that theis woman did. Oh no, I do not know that they would have any criminal relations whith each other. I never knew him to stay in her house all the night but he took her away one night and staid all night. This woman washed while she lived there. I could not tell whether he staid laite at night, he was there so much. Martin and this woman left here about the same time. I do not know where they went nor whether they left together. Martin's family left here shortly afterwards. Martin had a boy about 15 or 16 years old when he left here, I do not know who his mother was.

I do not remember the woman's name who left here when Martin did.

Yes her name was Jane.

No I do not remember whether her name was Bonner or Halterman.

Yes I believe that she had some chhildren. Q: How many? A: Two girls. I do not remember their names.

I do not know whether Martin came from Clay Co. Ill. I thinkk this woman came from Flora.

I heard about a yeara ago that Martin was in Thayer Mo.

Adm Commissions of Pensions
Washington D.C.

Sir,

I have the honor to return without report the papers in claim #506457 of Almira Elliott, widow of William D. Elliott, late of Co. I of 25th Wisconsin Vol together with papers in claim no. ? of Sarah J. Elliott wife #2.

Said claim was referred to me for the testimony of Sarah J. Elliott, with whom the soldier lived at time of death, as to whether the soldier was previously divorced from first wife "Almira."

Sarah J. Elliott, and her daughter left some two years ago with Harrison Elliott, and now reside, so I was informed this morning, at 400 Palean St., Keokuk, Iowa.

It is also claimed that Sarah J. Elliott, had been previously married to one xxx Martin (but when & where I was unable to learn) from whom she had never been divorced. Mrs. Harrison Elliott, wife of the Harrison Elliott, with whom with Sarah J. and daughter are now living, states that she understood that the diseased soldier had married Annie Harmon of Freeport, Ills. prior to this marriage with Sarah J. the contesting widow.

The standing and reputation of Sarah J. Elliott is not good.

Very respectfully
C.M. McKnight

Note26 Oct 1893 Keokuk, Iowa; Deposition of Sarah Jane Elliott, made on 26 October 1893 at Keokuk, Iowa, before J.R. Moeden, Special Examiner:

...says she is 43 years old, work out for a living. P.O. at #404 Phelan St., Keokuk, Iowa.

I was born in White Co. Ind. don't know the name of the town as I was very small when I left there.

I came to Flora Clay Co., Ill with my parents (now dead) from White Co. Ind.

My maiden name was Bonner. My father's name was Tyre Bonner.

I left Flora Illinois nine years ago and moved to Fairfield Ills. and lived there [?] or [?] mos. I lived in Parkersburg, Richland Co. Ill. for three or four years.

My first husband's name was Elijah Halterman. I was twenty one years old and he was seven months older than I when were were married. Neither of us had been previously married.

I married Halterman August 9th, 1872. Halterman was a member of Co. "G" 136th Ills Inf.

Halterman died at Watson, Effinhame Co., Ills April 1st 1881.

I was married to Halterman at Flora Ill by the Rev. Mr. Ray Aug 9 1872.

My next husband was Silas Martin. I married Martin at Rynard, Wayne Co. Ills. in Aug (the 7th) 1883. We were married by a Justice of the Peace who lived in town. I have fogotten his name and I never saw him before he married me to Martin.

I lived with Martin about three weeks and left him because I heard that he had a wife living when he married me.

Martin was a carpenter and contractor. I have heard that Martin was dead. Martin lived at Fairfield near Rynard when I married him.

I hadve a letter from a woman after I married martin in which she claimed to be his weife. I showed the letter to Martin and he did not deny it; did not say anything and so I left him.

My next husband was Wm. D Elliott. I got acquainted with him at Blair Neb. I did not know him only two months before I married him.

I was married to Elliott Nov 4th 1884 at Ainsworth Neb, Brown Co. We were married by Judge Hanks of Ainsworth Neb.

He (Elliott) told me that he had been married and had grown children but that he had been divorced from his wife and had not lived with her for yeas and years. He told me that he had been divorded from his wife who lived at Pekin Ills. and so after we were married I worte to the County Clerk at Pekin Ills to find out whether he had been divorced from this woman and the answer came back that he had and that it was a matter of record. This woman's first name was Annie, don't know what her maiden name was. It final appears that this Ills woman was a second wife.

After Elliot died Judge James Huff of Fremont NEb got a letter from some place in Wis. (Fairplay, Grant Co., I think was the place) from a woman who claimed to be the wife of Wm. Elliott the solderi. This woman's madien name was Almira Smith.

Wm. Elliott was [?] insurance all of the time I knew him and I heard that he had been before I married him so I have. I also heard but he had been in the INsame Asylum at Lincoln, Nebraska before I married him and had just got out at the time or a little before our marriage.

I never attempted to get a divorce from Martin as I though there was no record of it as thought our marriage was null and void from the beginning.

W.m Elliott was my last husband. I have not bee married since his death.

He (Elliott) died March 6th 1891 at Fremont, Neb. and I left there July 14th 1891 and went to Quincy, Ills.

Thomas J. Elliott a brother of the soldier and my two daughters by Halterman came on with us.

Harrison Elliott joined us at Council Bluffs Iowa and came on to Quincy with us and has lived with me ever since.

Harrison Elliott was a married man and had left his wife at Fremont, Neb. Harrison is at Council Bluff Iowa has been gone three or four weeks.

Harrison Elliott has boarded with me ever since he left Council Bluffs and as a boarder only. I have not lived with Harrison Elliott as his wife nor have I coahabited with him or any other men.

Halterman died of disease of the lungs, consumption. Dr. Hummers of Eelrow, Effingham Co., Ill attended the soldier Halterman during his last illness. The lung disease from which Halterman died was the result of a server cold in service. He had lung trouble all the time I lived with him and for four years before he died he was unable to do any kind of work.

I had two children by Halterman. Florence E. born Aug 8th 1874 and Lida L. born August 29th 1878. Florence was born at Flora and Lida was born at Parkersburg Ill.

Margaret & Sarah Bales were present at the birth of Florence. Mary Bolinger & Mrs. Mrs. Minick ([?]) were present at the birth of Lida. Dr. Jerry Bowman was present a the birth of Florence and I have forgotten what the physician's name was that was present at the birth of Lida.

In making application for pension as the widow of Halterman I neglected to put in the name of "Sarah".

I have never seen the woman Almira elliott who claims to be the first wife of Wm. Elliott.

I can prove that Halterman [??] in service by Runalds Brock who did live in Pann Ills. He was a mess mate with him all through [?] he is the only one as [?] rest of his comrades who knew him in service are dead.

He was only 14 when he enlisted. One Dr. Bowman of Flora treated Halterman when he was discharged and was the family physician all of the time for the soldier and his family while they lived in Flora.

Halterman was born and raised near Flora Ills. Jerry Bowman, a son of the [?] and the next Dr. [?] treated him was Dr. Green of Parkersburg Ills and then Dr. Hermmer took him in charge.

The Meyers family, Peter eolalosin, James Baker, James Praleis, Wm. Tatman and many others knew him well from to his enlistment and after his discharge and up to the time of his death. They all live at Flora.

Dr. Greens family, the Balunger family and Erikc Allhouse all of Parkersburg Ills know him well while he lived there. John Paker of that place was his intimate friend. Halterman lived in Flora and Parkersburg all his life - exepting one year that the lived in Blair Neb.

We (Halterman and I) lived in Blair NEb for nearly one year before he died. He had a sister living there and went out there for his health. I did not get acquainted with Wm Elliott the soldier when I was at Blair Neb with Halterman.

Yes when I married Elliott I thought I had the right to marry him as he told me that he whad been divorced which was in part true, but the divorce was from his 2nd wife not from the first.

I have understood your questions and my answers are accurately recorded.

Mrs. Jane Wise I regard as a woman of no principle. She denies that she was in any way responsible for the improper relations existing between the soldier and her daughter, but the whole history of the case appears to give the lie direct to that denial. On this ground I rate her as not of good standing for truth.30

Note*26 Mar 1895 Marceline, Linn Co., Missouri; I am 56 years old. Post office as above (Marceline, Linn Co., Missouri). Occupation SInger Sewing Machine agent. I served in Co. H. 17 Regt Indiana Ifn. I enlisted in 1861 and was discharged in 1865.

I am a pensioner at the rate of eight dollars.

Before my enlistment I lived at Princeton Ind. and returned there after my discharge. Where I remained about one year, from there I went to Kansas City, from there to Effinham, Illinois, and remained a few months, from there I went into Louisville in Clay Co. Ill., I then went to Johnsonville Tenn, then to Gina Illinois, thence to Effingham. I remained there from Sept. till March 1868 thence to Sullivan Moultrie Co., Ills. remained there about 8 months, then to Col Co. Ills. (Mattern) thence to Effinhaam Ill. thence to Osage City Mo. thence to Jefferson Co. Mo. thence to Girard Kansas thence to Carmi, White Co., Ill in 1880. I was there about two or three years, and then went to Fairfield, Wayne Co., Ills. I think I was there about a year and a half, leaving thee in 1884. I then went to Thayer, Oregon Co. Mo. thence to Kansas City, Mo. thence to Rock Island Ills. thence to Kansas City Mo. thence to Marceline Mo.

I have been married twice. I married my first wife at Princeton Ind. in 1868. Her name was Sarah Childers. I have no record of my marriage to her. I was informed that I had obtained a divorce from her in Kansas City Mo. in 1867 or 1868 or 1869. I have no decree, but I had applied for a divorce on the grounds of incontancy and believed I had obtained it, a man named Slaughter was my attorney. He was an old [?].

I next married Rosanna J. Madden at Sullivans Moultrie Co., Ills. in 1869, Spring. I have no marriage record. I have lived with my present wife ever since and there has never been any separation between us.

I never knew a woman named Sarah J. or Samantha J. Bonner4 but I knew a Samantha J. Cook who was afterwards Halterman. I first met her at Louisville Clay Co. Illinois in 1866. She had a mother and father there, and was about 17 years old. I cannot say whether she had ever been married before or not. Her folkds lived there, but cannot tell how long they had lived there. I do not know her character at that time.

Ques. Were you ever married to this woman? Ans. Not that I know of, unless the marriage was performed while I was drunk, and in those days I was drunk about seven days in the week. I was particularly intimate with this girl there. I hardly think I had intercourse with her there, hardley think I could have done so while drunk, I was often in her company while intoxicated but I recall no occasion when a marriage ceremony could have been performed. I never travelled with her, never knew of any mock ceremony to her - formed between us. I think it possible that some marriage ceremony to be performed between us, and it is probable that we were married while I was intoxicated and in June 1867 I was on a railroad running through Clay, Effingham, and Wayne Counties, Illinois, and still kept up my acquaintance with her and did not leave there until October 1867 and frequently was in Louisville for a day or two. I would go there for my "periodicals".

I never heard the name Bonner and do not know whether Samantha Cook had a step father named Cook or Bonner or not but I think the woman Sarah Connard was the woman who lived with Samantha Cook. afterwards the widow Halterman in Fairfield Ills.

When I left the neighborhood where the Cook woman lived I went to Johnsonville Tenn. She did not go with me. I last saw her at her father's house called there a few times. At this time I did have a wife living, and the Cook woman knew nothing about it, and as far as I know none of the people around there ever had occasion to know anything about my first wife then living.

After I left Louisville Ills in 1867 I next met the Cook woman in Fairfield Ills in 1884. She then went by the name of the Widow Halterman. I do not know how she got there, do not know whether she was there before I came of not. I met her by chance in Fairfeild and she told me she had been there a few days. I do not know what she was doing for a living. I began an acquaintance with her while she was there and I "run" her but did not support her. I call it "running" her, because I was there at her house very often and had intercourse with here there on four times, maybe oftener. I went to her house at night and after night but I never sayed all night with here and never went away from Fairfield with her. She was certainly the same woman I had known before in Louisville, Ills. but she never alluded to my having married her before and I was not married to her in Fairfield Ills. in 1882 or 1883.

Ques. Can you say positively you were not?

Ans. No. But I think not and if I even was it was when I was drunk.

This Halterman widow never spoke of my first wife while at Fairfield, for she knew that my present wife was right there. We had five children there with us. My wife and I, and a son of mine by my first wife. His name is C.H. Martin he now lives at Thayer, Oregon Co., Mo. and is about 32 years old.

I had never seen the Cook woman from the time I left Louisville, Ill. until I went to Fairfield in 1882 or 3 and as for having married here in 1883 at Rymound or some similar place in Clay Co., Ills. I have no knowledge of any such place.

This Halterman widow had two children living with her at Fairfeild, she claimed they were hers don't know what name they went by. She also had a woman there, whom she claimed was her sister.

I heard nothing against the reputation of these women while they were in Fairfield. I was a carpenter and builder while in Fairfeild, and had been there from September to July before I met her. I went to Kansas City and Tahyer Mo. after leaving there. I never have never seen her since leaving there.

I knew of W.D. Hay of Fairfield Ills. and built a house for his mother but I do not recall any such conversations as he repeats as having had with me. I left my wife in Fairfeild Ills. when I left there. She remained there about two weeks longer but I never heard that the woman left there the same time I did.

I knew Stephen Rogers and have heard his statement.

Ques. How do you explain the statements of Geo. Taraken and Stephen Rogers that you left here and that thes women left at the same time?

Ans. She may have really left about the time I did, but I think she did not leave with me.

Ques. How did Geo. Taraken get the idea that she was your first wife?

Ans. I do not know. My wife came to Fairfield Ill. in the November after the September I came there and lived with me all the time I remained.

I have never heard from the Halterman woman in any way since I left there.

Ques. How do you explain the marriage certificate shown you which shows that Silas L. Martin married Sarah J. Bonner in Clay Co., Ills in 1864?

Ans. I cannot explain it. It may be that I am the Silas L. Martin mentioned there but I cannot explain it.

Ques. Can you swear that you never knew or heard of a woman named Sarah J. or Samantha Bonner?

Ans. Yes, but the Cook woman might have had this name, or her relatives might have had this name and I not know it.

Ques. Do you positively swear that you were never married to the Cook or Bonner woman?

Ans. Yes, as far as I know, and the reason I cannot be positive I was never married is because I was intoxicated a great deal in those days and because the marriage certificate shown states that Silas L. Martin was married.

Questions understood. Answers correctly recorded.

In regard to Rebecca R. Statement that Fremont, Harrison Elliott, used to come to see me nearly every night and at time stayed all night. He never came to see me personally or at all there. Yes I went out buggy riding with him. Often when we were together, he would kiss his wife good by, and kiss mama and me both good by too. He never bought any clothes for me at Fremont, Nebr. but he bought a dress for me and his daughter at Neola while I was on a visit to his family. I went back with him to Neola that time. I don't remember sitting on his lap only when her daughter and I would be acting silly. Her statement that I was intimate with Harrison Elliott before 1892 is not true. Fannie Shanahan is the daughter I spoke of when I said we were silly in cutting up. I had no talk whatever with Fannie about her forgiving me or anything of that kind... Since hearing Luella's testimony I remember that Dr. Schmidt called that spell at Quincy an epileptic spell. That statement that I threatened to kill myself wasn't so. I did not sleep down stairs as Luella says. When Elliott was sick my mother and I did sleep down stairs to take care of him. When Luella was at our place in Quincy, she let on to be afraid of her mama. I heard her curse her mother. I deny too that I ever wrote to Elliott that I could not take care of myself and the baby. He was always writing me to come. I deny that we ever told Luella that I had been married to my cousin. At Keokuk, we did give out the statement that my husband was dead.... I deny too that Luella ever saw Mr. Elliott and me in bed together. Harrison Elliott's statement that we were at Miss Johnson's two or three days is wrong. We were not there over night and Harrison Elliott the soldier did not ask for a room for his wife and family. Harry never saw his father and me in the same bed.14
Note13 Apr 1899 From report of J.H. Hines relating to the competing widows claims to the pension of Harrison Elliott:

I rated Florence E. Elliott as of fair reputation for truth. I believe she was more sinned against than sinning, and that she has bitterly repented of her share in this domestic complication. I her statement before me, whe seemed truthful and honest. I ade considerable inquiry, and I believe that she is now trying to do right. She takes in washing to support herself and three small childen, one of whom is an imbecile, and a heavy and constant burden. it is a pity that Harrison Elliott was not killed years ago by some of his victims. He has left behind him a trail of misery and degradation that is appalling.15
